Product Liability Law
The Product Liability Law (PL Law) is one of the most important laws for manufacturers. We are providing practical legal advice to avoid problems relating to the PL Law from the product development stage, which includes: what kind of product design would be required not to be considered as “defective” under the PL Law; and what kind of product labeling would be required to be considered as “free of defect in labelling.”
Since it is quite important to implement appropriate strategies for appropriate resolution and settlement of claims and disputes under the PL Law, such as preservation of the relevant sites, possible method of proof, possible method to collect evidence and responses to the media, we provide appropriate legal advice on the initial response, the method of dispute resolution or other matters as well, and also act on behalf of our manufacturer clients in negotiations and litigation.
Export-related manufacturers also must anticipate the possibility of becoming involved in foreign PL disputes. In the event that PL litigation occurs in a country such as the United States which has implemented a complex discovery system, merely responding to discovery requests imposes a tremendous burden both financially and otherwise on Japanese companies.
Based on our broad experience handling disputes involving PL Law both in Japan and in foreign countries, and the resulting accumulation of related practical know-how, we are able to provide efficient and effective legal representation in such matters.
