Injunction Demands and Lawsuits

Qualified consumer organizations who have been certified by the Prime Minister may demand a business cease any of the acts prescribed in the Consumer Contract Act, the Premiums and Representations Act, the Act on Specified Commercial Transactions, and the Food Labeling Act (such as unjust solicitation, unjust terms, and unjust labelling), and, as of March 2025, there are 26 organizations in Japan that are certified as qualified consumer organizations.

Our firm has experience in dealing with various stages of inquiries, applications, and lawsuits from qualified consumer organizations. In the event that a client has decided not to dispute the accusation, our firm will consider an appropriate solution in order to minimize the impact on our client's business. In the event that our client wishes to dispute the accusation, we will take a firm stand as our client's representative, keeping in mind that it may lead to a lawsuit. If it proceeds to a lawsuit, we will handle it strategically while keeping the final resolution in mind.

Our firm also uses our knowledge of the latest developments to handles consumer-related litigation, including lawsuits for confirmation of common obligations under the Act on Special Measures for Consumer Court Proceedings and other new types of lawsuits.
