Expectations, Challenges, and Legal Issues of Digital Health in the Workplace
While the use of digital health and AI in the workplace holds great promise, it also presents numerous challenges, including not only the strength of the evidence and technical validity but also a range of legal and ethical issues. Using hypothetical cases, we examined the use of digital health and AI in the workplace from the perspectives of occupational health practice, privacy law (including the Act on the Protection of Personal Information), and employment and occupational health law. We identified key issues, including obtaining informed consent; information sharing within and between organizations; worker profiling and the use of assessment results; collecting information outside working hours; and decisions on whether and how to implement such systems.
